These Terms of Use govern access to and use of Local Sales Locator. By browsing the website, creating an account, submitting content, purchasing a listing or sponsorship, or using another service feature, you agree to these terms. If you do not agree, do not use the service.
Beta Service
Local Sales Locator is currently in beta. Features, pricing, coverage areas, availability and site behavior may change. We may correct errors, interrupt service, modify features or remove test data when reasonably necessary. Please report problems through our Contact Us page. Beta status does not limit rights that cannot be limited under applicable law.
Eligibility and Accounts
You must be at least 18 years old and able to enter a binding agreement to create a seller account, purchase a listing or submit a sponsorship. You are responsible for accurate account information, safeguarding credentials and activity performed through your account. Notify us promptly of suspected unauthorized use.
Listings and Seller Responsibilities
Sellers are solely responsible for their sale events and submitted information. You represent that you have authority to advertise the event, address, photographs, logos and other content; that the information is accurate and not misleading; and that the event and items offered comply with applicable laws, permits, taxes, safety rules and property restrictions.
You must promptly update, postpone or cancel a listing when circumstances change. Do not post illegal, stolen, recalled, counterfeit, dangerous or prohibited items; discriminatory or deceptive content; malware; private information belonging to another person; or content that infringes intellectual-property or privacy rights. Local Sales Locator may review, edit for formatting, reject, suspend or remove content, but is not required to verify every listing or seller.
Address and Personal Safety
Publishing a sale may reveal a residence, business or event location. Sellers choose whether an exact address appears immediately, is delayed until the event begins, or is limited to community and ZIP code. Sellers remain responsible for choosing appropriate privacy and safety settings. Shoppers are responsible for personal safety, lawful parking, property boundaries and respecting event rules.
Special Events and Sponsorships
Association with a community sale, citywide sale, market or other Special Event Series does not by itself mean the organizer endorses a listing. An “official participating stop” may require separate verification. Sponsorship payment makes an application eligible for review and does not purchase an endorsement or guarantee approval, placement, impressions, traffic or sales.
Fees, Promotional Codes and Payments
Prices and included features are shown before checkout. Payments are processed by Stripe and are also subject to Stripe’s applicable terms. Promotional codes may be limited by date, campaign, account, email address, listing type or number of redemptions; have no cash value; and may be changed or cancelled when unused. Attempting to evade limits or misuse a code may result in cancellation.
Refunds
Fees generally cover submission processing, review and the purchased publication period. Except where required by law, a published listing is not automatically refundable because an event changes, is postponed or cancelled, or does not receive a particular amount of traffic, inquiries or sales. Contact us if a paid listing is rejected before publication, a duplicate charge occurs or a verified technical error prevents the purchased service. Approved refunds are returned through the original payment method. Free and promotional listings have no cash refund value. Rejected paid sponsorship applications are eligible for review for a refund.
Shopper Tools and Third-Party Services
Search results, maps, directions, saved sales, routes, alerts and event details are provided for convenience. Dates, inventory, prices, addresses and availability can change. Verify important information before traveling. Mapping, payment and other external services are governed by their own terms and policies, and Local Sales Locator is not responsible for an external service.
User Content License
You retain ownership of content you submit. You grant Local Sales Locator a nonexclusive, worldwide, royalty-free license to host, store, reproduce, resize, format, display and distribute that content as reasonably necessary to operate, promote and improve the directory and related social or advertising materials. This license ends when content is deleted from active systems, except for backups, legal records and materials already lawfully distributed.
No Marketplace Transaction or Endorsement
Local Sales Locator is an advertising and discovery directory. Unless expressly stated, we are not the seller, buyer, auctioneer, event organizer, broker, insurer or guarantor of items or transactions at listed events. We do not take possession of merchandise and do not guarantee sellers, shoppers, listings, sponsors, item condition, legality, safety, quality or availability.
Disclaimer of Warranties
To the maximum extent permitted by law, the website and services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant uninterrupted operation, error-free information or any specific business result.
Limitation of Liability
To the maximum extent permitted by law, Local Sales Locator and its owner, operators, contractors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, lost data, personal injury, property damage, disputes between users or reliance on a listing. Our aggregate liability arising from a paid service will not exceed the amount you paid Local Sales Locator for the specific service giving rise to the claim during the six months before the event. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply.
Indemnification
You agree to defend, indemnify and hold harmless Local Sales Locator and its owner and operators from claims, losses, liabilities and reasonable expenses arising from your event, items, transactions, content, violation of these terms or infringement of another person’s rights, to the extent permitted by law.
Suspension and Termination
We may restrict or terminate access, remove content or refuse service for suspected fraud, abuse, security risk, nonpayment, legal exposure or violation of these terms. Provisions that by their nature should survive termination will survive.
Governing Law
These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any court proceeding must be brought in a court of competent jurisdiction in Illinois, unless applicable law requires otherwise.
Changes and Contact
We may update these terms by publishing a revised version and effective date. Continued use after publication constitutes acceptance of the revised terms. Questions may be submitted through our Contact Us page.
